We collect personal information when you use our website(s), mobile apps, and other online and offline products, services and experiences (collectively, the “Services”). Please take a moment to read through this Policy in its entirety.

1. What Personal Information We Collect and How We Collect It

We collect personal information that you provide directly to us, including:

  • Contact information. If you sign up to receive our newsletter, emails, or text messages from us, we will collect your name, email address, mailing address, phone number, and any other information needed to contact you about the Services.

  • Payment information. To order products or services through the Services, you will need to provide payment information (like your bank account or credit card information). Please note that your financial information is collected and stored by a third party payment processing company; use and storage of that information is governed by the third party payment processor’s privacy policy.

  • Survey and promotional information. You may provide us with other personal information when you fill in a form, respond to our surveys or questionnaires, provide us with feedback, participate in promotions, or use other features of the Services.

2. How We Use Your Personal Information

We use the personal information we collect for the following purposes:

  • To send you our newsletter, or other information or marketing about our Services that we believe may be of interest to you.

  • To reply to your questions, inquiries, or customer service requests or to send you notices, updates, security alerts, or support and administrative messages.

  • To provide you with information about our Services that you request or that we believe may interest you.

  • To monitor and analyze trends, usage and activities in connection with our Services and to improve the Services.

  • To facilitate contests, sweepstakes and promotions, and to process entries and provide prizes and rewards.

  • To detect, investigate and prevent fraudulent transactions and other illegal activities on the Services and to protect the rights and property of us and our customers.

  • To carry out our obligations arising from any contracts entered into between you and us, including for billing and collection.

  • For promotional offers and vouchers. To determine your eligibility for and to deliver promotional offers (for example, a complimentary Uber voucher), verify identity, and follow up about that promotion as permitted by applicable law.

3. How We Contact You & How We May Use Your Contact Information

By providing us with your contact information (phone number, mailing address, email), you agree that we may contact you regarding:

  • Service confirmations, administration, and customer support.

  • Promotional messages, marketing about our Services, and opportunities relevant to individuals affected by auto accidents (e.g., safety programs, legal services, marketing services).

  • Delivery of vouchers, prizes, or special offers you have requested or that you are eligible to receive.

Promotional communications and consent:
We will send marketing messages only if you have given consent where required by law, or as otherwise permitted (for example, if you are a customer or participant in a promotion). For promotional SMS/text messages or automated calls, we will obtain any required prior consent and will provide clear opt-out instructions in each message (for example, replying STOP to opt out of SMS). Message frequency may vary; carrier message and data rates may apply.

Targeted advertising / look-alike audiences:
We may use contact information (for example, hashed or otherwise pseudonymized identifiers) to create audiences on third-party advertising platforms so we can deliver relevant ads. We do not sell your contact information for third-party direct marketing without your consent. Where required, we will get consent before sharing contact information for a third party’s direct marketing.

Use in outreach related to accidents:
We may use contact information to reach out about programs and services for people who have indicated interest in or who may benefit from services following an auto accident. We will handle all such communications sensitively and in accordance with applicable law.

4. Promotional Voucher (Example: $25 Uber Voucher)

If you participate in a promotion that offers a complimentary voucher (for example, a $25 Uber voucher as part of our Anti-Accident Club), the following applies:

  • Eligibility & verification. We may use your contact information and submitted details to verify eligibility and to issue the voucher. We may share necessary information with our third-party voucher provider (e.g., Uber or voucher fulfillment vendor) to deliver the voucher.

  • Delivery. Vouchers will be delivered by email, SMS, or an in-app method as specified in the promotion materials.

  • Consent to contact. By accepting a voucher, you consent to being contacted about the promotion and related follow-up communications. If you do not want marketing beyond the voucher delivery, follow the opt-out instructions provided.

  • Terms and availability. Voucher offers are subject to availability, sponsor and partner terms, and may be limited to one per person. Additional terms will be posted with each promotion.

  • Data retention. Information used to issue and verify vouchers will be retained only as long as necessary to deliver the voucher, resolve disputes, and meet legal obligations.

5. How We Share Your Personal Information

We may share your personal information in the following ways:

  • With vendors, consultants, and other service providers who process your personal information on our behalf when they provide services to us (for example: data analytics, voucher fulfillment, marketing platforms, email/SMS delivery vendors, and payment processors).

  • With third-party partners or sponsors for promotions when you have opted into or otherwise authorized such sharing.

  • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company.

  • When required by law, or to comply with legal obligations, court orders, or government requests.

We require our service providers to use appropriate technical and organizational measures to protect personal information and only process it for the purposes we authorize.

6. Your Marketing Choices & Opt-Out

  • You can unsubscribe from marketing messages through an unsubscribe link we include in emails, or by contacting us at marketing@thenofaultgroup.com.

  • For SMS/text messages: you can opt out by replying STOP to the message, or by contacting us at the email address above.

  • Even if you opt out of receiving marketing messages, we may still send you non-promotional messages (for example to deliver your voucher, to respond to a request, or for transactional account information).

7. Retention of Your Data and Deletion

Your personal information will not be kept longer than is necessary for the specific purpose for which it was collected.

When deciding retention periods we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, why we need it, and any legal requirements.
